Alameda ADU Regulations Made Simple

Building an ADU in Alameda requires compliance with both California’s ADU laws and local regulations. Here’s a quick overview of what you need to know:

ADU Size Limits:

  • Detached ADU: Maximum 1,200 sq. ft.
  • Attached ADU: Up to 50% of the main home’s size, with a maximum of 1,200 sq. ft.
  • Junior ADU (JADU): Maximum 500 sq. ft. and must be created within the main home.

For lots with space constraints, state law guarantees that an ADU of up to 800 sq. ft., 16 feet tall, with 4-foot rear and side setbacks is always permitted.

Height Limits

  • Detached ADUs can be up to 16 feet tall, measured from the ground to the peak of the roof.
  • In FEMA Flood Zones, ADUs may exceed 16 feet to meet elevated floor requirements, but interior ceiling heights cannot exceed 8 feet.

Setback Requirements

  • Rear and Side Setbacks: Minimum of 4 feet for detached ADUs.
  • For existing structures (e.g., garage conversions), setbacks may not apply.

Lot Coverage

  • The total footprint of all buildings on the lot cannot exceed 60% of the lot area.
  • The ADU footprint cannot cover more than 40% of the rear yard area, or 400 sq. ft., whichever is greater.

Parking Requirements

  • No additional parking is required if your property is located:
    • Within ½ mile of public transit (all of Alameda qualifies, except Creedon Circle).
    • Within a historic district.
    • Within an existing primary structure or garage conversion.

Short-Term Rentals Prohibited

  • ADUs must be rented for a minimum of 30 days and cannot be used as short-term rentals (e.g., Airbnb).

Owner-Occupancy

  • ADUs: No owner-occupancy is required.
  • Junior ADUs (JADUs): The property owner must live in either the main home or the JADU.

Multifamily ADUs

  • Multifamily properties (e.g., apartment buildings) can add:
    • Attached ADUs: Up to 25% of existing units, converted from non-livable spaces like storage rooms or basements.
    • Detached ADUs: A maximum of 2 detached units per lot.

Garage Conversions

  • Garages can be converted to ADUs or demolished to make space for a new ADU. If the garage was built before 1942, a Certificate of Approval is required to determine whether it qualifies as a historic resource.

Fire Sprinklers

  • Fire sprinklers are only required for the ADU if the main home has sprinklers installed.
